Haier Smart Home Service Terms
Before using Haier Smart Home Services , please be sure to read the Haier Smart Home Service Terms ("Terms of Service"), especially the terms of the exemption/restriction of liability(marked in underline) . If you are under the age of 18, please read these Terms of Service with your parent or legal guardian to ensure that you and your parent or guardian fully understand the full terms of these Terms of Service.
Haier smart home services(or "services" ) offerred by the Qingdao Haier Technology Co., Ltd("Haier" or "we"). This Service User ("You" or "User") may remotely connect to any product (including Haier products and non-Hai products) for which the Service is applicable for the purpose of controlling the Product (Device Control) or using any other related services.
Validity and revision of the terms of service
1 These Terms of Service will be used to determine, adjust and manage the legal relationship between Haier as a service provider and users who are service users when using Haier Smart Home Services. In the process of registering your Haier account, if you do not agree to the Terms of Service or any of the agreements, you should immediately stop the registration process. By registering or using Haier smart home services, you acknowledge and are willing to accept the terms of this Service.
2 When you use a specific service of Haier Smart Home Service, there may be some special terms ( " Special Terms " ). These special terms should be considered as a supplement to these Terms of Service and are an integral part of these Terms of Service. In the event of a disagreement between these Terms of Service and any special terms, the terms of the disagreement shall prevail.
3 When you connect non-Haier products through Haier Smart Home Service, in addition to complying with the terms of service, you should also abide by the terms and conditions of use of relevant third parties .
4 We may amend these Terms of Service from time to time, to the extent permitted by applicable laws and regulations. If any amendments to these Terms of Service have a material effect on your rights or obligations, we will notify you in advance by reasonable means. If you continue to use Haier smart home services after the amendments to these Terms of Service become effective, you have read, understood and unconditionally agreed to such changes.
Your Haier account registration
1 Haier aims to allow users to enjoy all services of Haier through an account. Therefore, for the purpose of using this service, you can open a new Haier account, or you can use any of your products in Haier and any registered account of any terminal ( " Haier account " ).
2 You should always pay attention to your Haier account security (for example, avoid using too simple user passwords, avoid sharing accounts with third parties). We are not responsible for any damages resulting from unauthorized use of your account . If you find any unauthorized account usage or other account security issues ( such as password theft ) , you should contact us immediately by email or online customer service. Haier reserves the right to terminate your Haier account in the event of any unauthorized use of your Haier account or Haier smart home services (or Haier has reasonable grounds to suspect).
3 You fully understand and agree that you are responsible for all actions under your account. For the avoidance of doubt, Haier is not responsible for any damage or loss caused by your account.
4 Haier reserves the right to terminate your Haier account if you violate these Terms of Service or engage in illegal activities. You shall be liable for any and all losses (including Haier's losses).
1. Haier smart home service is suitable for individuals who are 18 years of age or older. If you are under the age of 18 , you must use your parent's or legal guardian's permission to access or access Haier Smart Home Services. By agreeing to the Terms of Service , you warrant to us that you are 18 years of age or, if you are under 18 years of age, you have obtained permission from your parent or legal guardian to use the Service ;
2. You comply with any and all applicable laws and regulations regarding the registration and use of the Service.
License grant and restriction of services
1 All intellectual property Haier smart home services, between you and Haier, Haier are owned by all. All trademarks (such as Haier), service marks and trade names used in or related to Haier smart home services are owned by Haier; all content, data, information, etc. in Haier smart home services (except for user-created content and partner content) , including but not limited to text, code, graphics, photos, sounds, music, video, and all intellectual property rights therein, are the exclusive property of Haier.
2 Subject to your Terms of Service, Haier grants you a non-exclusive, non-transferable, limited, revocable personal access and access to and use of Haier smart home services. In addition to the rights granted to you under these Terms of Service, Haier reserves all rights in Haier smart home services or in connection with Haier Smart Home Services. To the extent permitted by law, Haier may, at any time and in its sole discretion, restrict access, suspension or termination of all or part of Haier smart home services without notice.
3 You agree to use the Service solely for personal, non-commercial purposes and you agree that you may not:
(1) interfere or attempt to interfere with the operation or use of Haier smart home services by any means or equipment in any way, including but not limited to hackers or any other means;
(2) copying, editing, modifying, altering or extracting the source code of Haier Smart Home Service ( or any part of Haier Smart Home Service ) , or creating its derivative works, or reverse engineering, reverse assembly, reverse Compile, etc.
(3) Delete the information about intellectual property rights in the Haier smart home application;
(4) Any act not authorized by Haier.
Haier reserves the right to terminate all your Haier accounts or some or all of your account functions if you engage in the above actions or if we have reasonable grounds to suspect that you are doing the above .
4 In order to improve Haier's smart home service, Haier may update Haier's smart home applications from time to time (including but not limited to bug fixes and version upgrades). We will notify you when an update is available and you can refuse to install such an update. However, please note that if you refuse to update, you may not be able to use certain features of Haier Smart Home Service.
1 You can use the smart home service provided by Haier. You may not use Haier smart home services for commercial purposes or for any use that is prohibited by law or prohibited by these Terms of Service.
2 You agree, as part of the service , Haier can send you promotional materials related to Haier and its partners' products and services for promotional and promotional purposes. If you no longer wish to receive certain categories of emails or other promotional materials, you can follow the prompts to unsubscribe.
3 You acknowledge that certain features or services of Haier smart home services are linked to third party products and / or their related services, or provided by third parties ( “ Partner Services ” ). By using these partner services, you hereby license Haier to receive specific information about you from the appropriate partner service provider (if applicable). Your use of any partner services is subject to the terms and conditions of use set by the respective partners. For the avoidance of doubt, Haier does not make any kind of express or implied warranty of any function or service provided by any third party, and Haier does not assume and waive any liability related to or arising from any partner service, including but not limited to Functional failure. The Partner shall be solely responsible for any errors, deficiencies or inaccuracies related to the Partner Services or any issues in Haier smart home services due to partner actions or omissions.
4 You understand that several features of Haier smart home services need to be used in a network environment. When using these features, your network service provider may charge a fee for accessing their network. You will need to know the relevant tariff information from your network service provider and bear the relevant costs.
5 Haier will make reasonable commercial efforts to provide you with high quality services. However, Haier hereby reminds you that we do not make any type of express or implied warranty on Haier Smart Home Service. You fully understand and agree that you are solely responsible for the use of the Service, for example:
(1) encountering content that makes you uncomfortable;
(2) Remote operation of the product will require the use of electricity. If the operation time is too long, it may cause fires caused by, but not limited to, overheating, defects, short circuits, etc.;
(3) The use of Haier smart home services is interrupted or has occurred, or any part thereof is unavailable at any time or for any reason;
(4) The accuracy, authenticity and integrity of the relevant user information of Haier smart home application (that is, the information generated by the user using the access smart hardware or user input);
(5) Risks arising from the use of Haier's smart home services, access to third-party links that are not Haier, or the use of third-party products or services.
In addition to the special provisions of these Terms of Service, Haier is not responsible for any accidents, negligence, infringement and damages caused by the use of Haier smart home services, and does not assume any legal responsibility.
6 If you fail to comply with these Terms of Service or any other terms of any of the services applicable to your Haier account, Haier may, without prior notice to you:
(1) Termination of your use of Haier smart home services;
(2) Termination of the license granted hereunder.
7 You can opt out of some or all of Haier's smart home services at any time , for example by using the App , the device itself (for some devices) or the factory reset to individually unlink each connected device from the Internet or complete your account. Log out, but this will result in:
(1) You will not be able to use certain features of the Haier smart home services; and/or
(2) You can only operate the appliance through the appliance itself, and you can no longer perform operations through the Haier smart home services.
The content and license you created
1 upload by Haier smart home applications, transmit, display or provide any information, materials or other content in other ways ( " user-created content ") , you agree to Haier granted irrevocable, unrestricted, sublicensable , worldwide, free, permanent, and non-exclusive licenses that allow Haier to use your user-created content for any purpose (commercial, advertising, or other purpose) in any manner or in any medium developed now or in the future. , including but not limited to, copying, modifying, editing, adapting, translating, and displaying such user content (" User Content License ") . Haier will decide how to sign it based on its specific use of user-created content. If you have specific requirements on whether and how to sign, please provide written notice when providing your user-created content.
2 You are solely responsible for the user-created content that you provide, and any results that are caused by, or associated with, the content created by that user ( including any loss that Haier may suffer as a result ) . You hereby promise:
(1) Have all rights related to user-created content, or have been authorized to grant Haier “ User Content License ” ;
(2) User-created content does not infringe any intellectual property rights or any other third-party rights (for example, you should have express consent and / or permission from each identifiable individual in the user-created content to use each of the foregoing identifiable Personal name or portrait);
(3) User-created content does not contain any viruses or other harmful code;
(4) User-created content does not contain “ spam ” or any marketing activities that are not approved by Haier;
(5) User-created content does not include any laws, regulations, administrative regulations, etc. (including but not limited to the "Internet Information Services Management Measures", "Internet Post Comment Service Management Regulations", "Internet User Account Name Management Regulations" prohibited Other content (such as obscenity, pornography, gambling, violence, murder, horror or abusive crimes), or content prohibited by these Terms of Service.
Haier reserves the right to remove or refuse to post any User Created Content or terminate your account for any breach of this Agreement. You agree to indemnify Haier for any damages resulting from your breach of the above warranty and to ensure that Haier does not incur any third party related claims.
3 Haier is not responsible for user-created content . Any opinions expressed in the content created by the user do not represent Haier's views or values. Haier Smart Home Service is only used as a channel to distribute content created by such users. It does not endorse any user-created content or assume any obligation or responsibility for the activities of any user-created content or any and all users of Haier smart home services . Under no circumstances should you believe in borrowing, asking for passwords, or other user-created content that involves property.
Your personal information and privacy protection
1 In addition to the registration information you provided when you created your Haier account, we may also ask you to provide additional information that is only required for the purpose of providing services to you. You agree and are committed to providing accurate, up-to-date and complete information.
2 Haier attaches great importance to the protection of users' personal information and privacy. Haier may collect and use the personal information (including but not limited to registration information) required by you to use the Service only after obtaining your consent (for example, when you register your Haier account). Before using this service, please be sure to carefully read the relevant privacy policy of Haier Smart Home Service. For details, please refer to Haier's Home Appliances Privacy Policy and the supplementary terms, reminders and notices (collectively referred to as “Haier Appliances Privacy Policy”) issued from time to time. . The Haier Appliance Privacy Policy is an integral part of these Terms of Service. In the case of personal information and privacy protection matters, if there is a conflict between the Terms of Service and Haier's home appliance privacy policy, the Haier Home Appliances Privacy Policy shall prevail.
1 Haier shall not be liable for damage caused by the following circumstances:
(1) Any interruption or obstruction caused by hacker attacks, computer viruses, illegal content information, harassment of information, government regulations, and any other network, technology, communication lines, information security management measures, etc. The requested situation;
(2) Due to communication line failures, technical problems, network, computer failure, transmission delay, system instability and other losses caused by force majeure;
(3) Other errors, interruptions, defects and loss caused by operation;
(4) You have violated the agreement under this Agreement. For example, you may use Haier smart home services for any commercial or business purposes, and you may suffer business losses, including but not limited to loss of profits, data loss, business interruption or business opportunities. 2 These Terms of Service do not exclude or limit your legal rights as a consumer:
(1) Liability for death or personal injury caused by our negligence;
(2) Any other liability that is prohibited by law from being excluded or restricted.
In the event of force majeure (such as force majeure referred to in this paragraph, it refers to objective conditions that cannot be foreseen, cannot be avoided and cannot be overcome, including institutional factors such as changes in government policies), resulting in delays in performance or failure to perform under the Terms of Service. We are not responsible for the obligation. Haier may suspend the performance of its obligations under this Terms of Service within the scope of force majeure and duration until the impact of force majeure disappears. We will use reasonable efforts to find solutions to fulfill our obligations under the Terms of Service in the event of force majeure.
1 As any provision of these Terms of Service is deemed to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions are not affected or impaired.
2 You may not arbitrarily transfer the terms of service of your own without the prior written consent of Haier.
3 If there is any dispute or dispute between you and Haier, you should first settle it through friendly negotiation; if the negotiation fails, you agree to submit the dispute or dispute to the people's court with jurisdiction in Laoshan District, Qingdao, Shandong Province, China.
